Introduction
InfoSanta.net (“we,” “us,” “our”) respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (“DMCA”). This policy outlines the procedures for copyright owners to report alleged infringement of their works on our website, InfoSanta.net (the “Website”), and for users to respond to such notices.
Notice of Copyright Infringement
If you are a copyright owner or an agent thereof and believe that any content on our Website infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:
- Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, please provide a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. Please include information reasonably sufficient to permit us to locate the material (e.g., the URL of the page where the material is located).
- Your contact information, including your name, mailing address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature.

Takedown Procedure
Upon receipt of a valid DMCA notification, InfoSanta.net will take the following steps:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user or content contributor who posted the material that we have removed or disabled access to it.
Counter-Notification Procedure
If you believe that your content was removed or access to it was disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent. A valid counter-notification must include the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which InfoSanta.net may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the complaining party. If we do not receive notice within 10-14 business days that the original complaining party has filed an action seeking a court order to restrain you from engaging in infringing activity, we may, at our discretion, reinstate the material.
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, InfoSanta.net has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
